Pursuant to section 21 of the Retail Leases Act 2003, you are entitled to a lease for a term of at least five (5) years. This includes the initial term and all other deadlines provided for in the extension options. The completed document must be made available to all parties (including any guarantors, if applicable). Each party should have the opportunity to read the agreement and, given the length of the document, may take some time to do so. It is therefore important to determine whether or not the property for rent will be affected by retail tenancy legislation in the relevant state or territory. Each state and territory government has an office or division that deals with fair trade or small businesses (for example. B the Small Business Commissioner or the Consumer Affairs and Fair Trade Office). This is usually a good place to get information about retail leases in the relevant state or territory. A lease is a legal-grade contract between tenants and landlords, for which there is no cooling-off period. Finally, the lessor must provide the tenant with a signed copy of the lease for his parts.

See our Retail Lease Dispute Resolution pages for more information. Each state and territory of Australia has specific laws that stipulate that certain types of commercial real estate can only be leased through a “retail lease” (and not through a general commercial lease). The law also provides more restrictions for retail leases than for commercial leases. Short-term leases can be written or oral, but we recommend the use of written leases. Landlords and tenants can use our Form 1 – Housing Rental Agreement (Word, 1.5MB). . . .
